REVOKED ELD: Arion Tech Inc.’s ArionT ELD

On June 24, 2022, FMCSA removed the following device from the list of registered ELDs [eld.fmcsa.dot.gov] due to the ELD provider’s failure to meet the minimum requirements established in 49 CFR part 395, subpart B, appendix A. ELD Name: ArionT ELD Model Number: AT5000 ELD Identifier: AR1ONT ELD Provider: Arion Tech Inc. Motor carriers must discontinue using the revoked device and take action to stay in compliance FMCSA will be sending an industry email to let motor carriers know that all who use the revoked ArionT ELD must take the following steps:

  1. Discontinue using the revoked device(s) and revert to paper logs or logging software to record required hours of service data.

  2. Replace the revoked device(s) with compliant ELD(s) from the Registered Devices list [eld.fmcsa.dot.gov] before August 24, 2022.

Motor carriers have a grace period of up to 60 days to replace the revoked device(s) with compliant ELD(s). If the ELD provider corrects all identified deficiencies, FMCSA will place the device back on the list of registered devices and inform the industry and the field. However, FMCSA strongly encourages motor carriers to take the actions listed above now to avoid compliance issues in the event that the deficiencies are not addressed in time. When and how to cite violations During the grace period, safety officials should not cite drivers using the ArionT ELD for 395.8(a)(1) – “No ELD” or 395.22(a) – “Failed to use a registered ELD.” During this time, safety officials should request the driver’s paper logs, logging software, or use the ArionT ELD display as a back-up method to review the hours of service data. Beginning August 24, 2022, motor carriers who continue to use the revoked device listed above will be considered to be operating without an ELD. Safety officials who encounter a driver using the revoked ArionT device on or after August 24, 2022 should cite 395.8(a)(1) and place the driver out-of-service in accordance with the Commercial Vehicle Safety Alliance (CVSA) Out-Of-Service Criteria [gcc02.safelinks.protection.outlook.com]. Continue to report devices The ELD Technical Team became aware of the deficiencies of this device in part due to your reports from the field. We greatly appreciate all your efforts to notify us about ELD compliance issues such as these. Please continue to report any ELDs that may not meet the minimum requirements in the ELD technical specifications for investigation so that we can keep the Registered Devices list [eld.fmcsa.dot.gov] as accurate as possible. Nearly 1,300 Commercial Vehicles Put Out of Service for Brake Problems

Inspectors found 14% of the commercial motor vehicles inspected on an unannounced Brake Safety Day had critical brake-related violations that put them out of service. On April 27, 46 jurisdictions in Canada and the U.S. put 1,290 CMVs out of service for severe brake problems — 14.1% of the 9,132 commercial motor vehicles inspected that day. This unannounced one-day inspection and enforcement initiative, conducted by members of the Commercial Vehicle Safety Alliance, focuses specifically on the brake systems and components on commercial motor vehicles. Mike's Safety Tip

4th of July Safety Every year someone gets hurt by fireworks. Lets do our best to have a great celebration this weekend, but we need to make sure everyone is safe. Keep a supply of water close as a precaution. Make sure whoever is lighting the fireworks has safety glasses on. Only light one firework at a time. Store your fireworks in a cool, dry place away from kids. I wish everyone a great holiday weekend! Thanks Mike
